Use of Code Hub Hosting's Service constitutes acceptance and agreement to Code Hub Hosting's AUP (Acceptable Use Policy) as well as Code Hub Hosting's TOS (Terms of Service). From here with in this TOS, AUP, and SLA, the usage of "us", "we", "our", "ours" shall constitute reference to Code Hub Hosting, the usage of "you", "your", "they", "them" shall refer to client / customer of Code Hub Hosting.

Acceptance of Contractual Agreement

1. Client agrees that by placing an order either by means of electronic ordering (web order form) or submitting a written contract, and receipt of such order by Code Hub Hosting, that you are agreeing to our TOS, AUP, and SLA. No Modifications of said contract by customer is allowed.

2. Code Hub Hosting will provide, and Customer will purchase and pay for, the Services, and service fees specified in the Order for the applicable Service Description. Customer acknowledges that the service, and service fees have been communicated to the customer, and that they are aware of all applicable charges as per contract, AUP, SLA, and TOS. Customer also understands that any promotional offers unless specified in contractual terms will not be applicable to their individual service.

What may NOT be hosted on our network:

Customer agrees to use the Services for lawful purposes only.
Code Hub Hosting prohibits the following content on our servers and network.
You MUST not publish or transmit via Code Hub Hosting’s service any content that Code Hub Hosting reasonably believes: Constitutes child pornography.
Constitutes pornography.
Is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech.
Is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes.
Is defamatory or violates a person’s privacy.
Creates a risk to a person’s safety or health, creates a risk to public safety or health, compromises national security, or interferes with an investigation by law enforcement.
Improperly exposes trade secrets or other confidential or proprietary information of another person.
Is intended to assist others in defeating technical copyright protections.
Clearly infringes on another person’s trade or service mark, patent, or other property right.
Promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking.
Is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to Code Hub Hosting.
Disputed Services; this is incase a domain has ownership disputes; Code Hub Hosting will suspend the services pending the dispute resolution.
General Dispute; Code Hub Hosting hold high standards of integrity;any cases of conning, phishing,copyright infringement will be taken very seriously.
Code Hub Hosting holds the rights to suspends or terminate such services without notice.
An email notification will be sent(before or after) to you in such cases;the parties involved have The burden of proof.
Once Code Hub Hosting has verified the above proofs, the service will be reinstated or terminated.
Code Hub Hosting WILL terminate service for any of the above reasons and it’s at Code Hub Hosting WILL not issue a refund.
Hacker focused sites.
Proxy Scripts.
Anything related to torrents.
Starting background processes on shared servers.
Warez, hacking tools, exploits.
Any account found to be in violation of another’s copyright will be expeditiously removed, or access to the material disabled.
Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from our hosting.
Customer agrees NOT to use our shared, reseller, VPS or dedicated servers hosting space for storage of backups.
We advise customers to store their back up externally.
  

Payments and Fees

Payment is due every 6 or 12 months by credit card or PayPal, an invoice will be raised and can be paid from the Client Area, please note that service may be suspended on accounts that reach due date. Late Fees may be applied on the product depending on the delayed period of the invoice, some product may get higher renewal charges (which might not included in original invoice, as such charges depend on the delayed period of post renewall date. ) such as domain,VPS and Dedicated server. Delayed payment of invoice does not guarantee of renewal of services.

Background Running Programs

Code Hub Hosting does not allow background Daemons such as IRC bots; eggdrop; BitchX; XiRCON; and any other program that interferes with normal server operation. IRC Code Hub Hosting does not allow IRC or IRC bots to be operated on our servers.

Delinquent Accounts

Code Hub Hosting may temporarily deny service or terminate this Agreement upon failure of Customer to pay charges when due. Such termination or denial will not relieve Customer of responsibility for the payment of all accrued service fees, or any collection fees.

Account Cancellation

All requests for canceling any service / services must be made in writing with at least 7 days notice but not more than 30 days prior written via our support tickect include your domain name, last name on credit card in your email.

Refunds and Disputes

All payments to Code Hub Hosting are non refundable (unless covered by 7-day Money Back Guarantee). This includes any setup fees and monthly fees regardless of usage. All billing disputes must be reported within 30 days of the time the dispute occurred. Disputed charges to your credit card issuer, also known as charge backs, in Code Hub Hosting's discretion which is valid, under the terms and conditions of our SLA, AUP, and TOS, will result in service interruption, and reconnection fees to restore the desired service.
